Julie, fortunately I do not think things have gone that far here yet. That is evidenced by the fact that the league player discussed on the MENZ link got off. The jury could have found him guilty but a jury in Aust. would have had a lot more difficulty. Here as I understand it here if a woman is well and truly pissed and a man take advantage a jury may find him guilty of rape. It depends on the circumstances. For example if a man find a teenage woman paralytic and separated from her friends and he pulls her into an alley and she is to drunk to know what city she is in he is probably guilty of rape. If on the other hand they are both getting served in a bar then that is a different story.

The way guys get wrongfully jailed here is the definition of consent. It all depends on a jury. Some people say consent must be verbal. A women says no initially and after some kissing cooperates. The next morning the guy forget her name and she cries rape and a jury could convict. Juries can be funny. I was on a rape trial and this guy wanted to convict when the judge basically told us she was lying in his summing up.

Let us hope Labour does not manage to cobble together a coalition or we will have similar legislation in NZ.
